On the afternoon of 12 December, the second session of CIETAC Jinling Forum 2019 and the “Latest Changes of ‘Incoterms® 2020’ and Their Practical Application ” lecture, jointly organized by CIETAC Jiangsu Arbitration Center, Nanjing International Chamber of Commerce, and Nanjing Import and Export Chamber of Commerce, was successfully held in Nanjing. More than 300 business representatives, lawyers, arbitrators and scholars from Jiangsu, Anhui and surrounding areas attended the lecture.
“Incoterms® 2020” will come into effect on 1 January, 2020. The new version of trade terms further clarifies the responsibilities of buyers and sellers under the international trading system, which will have a significant impact on trade practices, international settlement and trade financing practices. This lecture focused on the latest changes in “Incoterms® 2020” and analyzed highrisk-raising terms from the perspective of a negative list. It helped enterprises correctly select and apply international trade terms and further master relevant international trade rules and standard practices. It sought to assist enterprises in risk prevention in international trade with the use of professional trade terms.
The lecture was chaired by Zhang Wei, Deputy Secretary General of Nanjing International Chamber of Commerce. Gu Yan, Vice President of CIETAC Arbitration Court and Secretary General of CIETAC Jiangsu Arbitration Center, delivered a speech on behalf of the organizers. He stated that CIETAC was established by the Central People's Government Administration Council to effectively resolve international trade disputes between China and foreign countries in the early days of the founding of the People's Republic of China. Over the past 63 years, CIETAC has accumulated rich experience in handling international trade disputes and has handled the most disputes involving Incoterms among domestic arbitration institutions. CIETAC Jiangsu Arbitration Center was set up to provide high-quality, efficient and convenient arbitration services and related legal services for enterprises in Jiangsu and surrounding areas to carry out international trade. He welcomed corporate legal counsels and lawyers to actively participate in the activities organized by CIETAC Jiangsu Arbitration Center.

In the keynote speech session, Xu Jun, Deputy General Manager of the Transaction Banking Department of the Bank of China Jiangsu Branch and a member of the Incoterms® 2020 Chinese translation team, analyzed the differences between Incoterms® 2020 and 2010 from a theoretical and business perspective. She also explained with practical cases about trade terminology such as insurance adjustment, term change and bill of lading submission under the letter of credit. Finally, she made four suggestions to enterprises on signing of international trade contracts, which were to correctly show that the rules are applicable, to use appropriate terminology after careful consideration, to treat terminology variations carefully, and to fulfil the obligations determined by the rules.

Zhang Zhenan, CIETAC arbitrator and senior partner of Shanghai Co-effort Law Firm LLP, on the basis of his experiences working in foreign trade and now as a lawyer and arbitrator, stressed the importance of learning Incoterms, CISG, UCP600, maritime law, securities law, and arbitration and litigation. He recommended that enterprises should include arbitration clauses in international trade contracts. In light of the characteristics of different trade terms, he also provided detailed guidance and suggestions through a number of case examples on practical issues such as the implementation of contracts and the prevention of potential risks.

This lecture was focused on practice, friendly to enterprises, and full of substantive knowledge. It provided guidelines and directions for enterprises to engage in international trade business and resolve international trade disputes. The forum was a sell-out event, conducted in a lively atmosphere and highly praised by the attendees. CIETAC Jiangsu Arbitration Center will continue to use CIETAC Jinling Forum and other platforms to invite people from all walks of life to discuss theoretical and practical issues on law, economy, trade and arbitration, provide arbitration service, and help enterprises develop steadily.
